  • Paid Music: Artists have the option to charge for access to their music. This feature allows artists to set a price per song or album, enabling them to earn revenue directly from fans who wish to support their work.
• Backstage Pass
  • Users can purchase a 'Backstage Pass' using the Dreamster utility token. This pass allows users to interact directly with musicians and artists on the platform, providing an enhanced and more personal fan experience. All transactions involving the Dreamster token are securely recorded on the blockchain, ensuring transparency and security.
• Token Staking
  • Users have the opportunity to stake their Dreamster tokens on the platform. By locking up tokens for designated periods, users can earn rewards. The specifics of the staking process, including the lock-up periods and the rewards, are clearly outlined on the platform, providing users with opportunities to earn while supporting their favorite artists.
• KYA – Know Your Artist
  • Artists looking to upload content and potentially charge for their music must complete the Know Your Artist (KYA) process. This process includes the verification of identity and other relevant details as required by law. Accurate and complete KYA submissions are necessary for maintaining the integrity of the platform and ensuring compliance with regulatory requirements.

• Account Registration: To access all features of Dreamster Music, users must register for an account. During registration, you may be required to provide us with certain personal information, such as your email address or cryptocurrency wallet address, which will be used to create and manage your account. You are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer or device, and you agree to accept responsibility for all activities that occur under your account or password.
• Account Responsibilities
  • Accuracy of Information: You promise that any registration information you provide to Dreamster Music will always be accurate, complete, and up to date. You may not impersonate someone else, create or use an account for anyone other than yourself, provide an email address other than your own, or create multiple accounts except as authorized by Dreamster Music.
  • Security: You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password. We encourage you to use "strong" passwords (passwords that use a combination of upper and lower case letters, numbers, and symbols) with your account.
  • Notifications: You must immediately notify Dreamster Music of any unauthorized use of your account or any other breaches of security. Dreamster Music cannot and will not be liable for any loss or damage arising from your failure to comply with this security obligation.
• Account Termination
  • By User: You may terminate your account at any time by following the instructions on the Dreamster Music platform. Terminating your account will not affect the availability of some of your content that was shared publicly or with others who have copied or stored it.
  • By Dreamster Music: Dreamster Music may terminate your account or restrict your access to the platform if we determine that you have violated any provision of these Terms of Agreement or that your conduct or content would tend to damage our reputation and goodwill. If we terminate or suspend your account for any reason, you are prohibited from registering and creating a new account under your name, a fake or borrowed name, or the name of any third party, even if you may be acting on behalf of the third party.
• Account Features: Once your account is created, you will be able to use the full range of Dreamster Music’s services, including music streaming, interactions with artists through the Backstage Pass, and participation in token staking. Each account feature is designed to enhance your experience and engagement with the music and artists on the platform

• Purpose of KYA: Dreamster Music implements the Know Your Artist (KYA) process to ensure the authenticity of artists on the platform and to prevent impersonation and fraudulent activities. This process is essential for maintaining the integrity of the platform and ensuring that all music uploaded is rightfully owned or licensed by the users posting it.
• KYA Process
  • Initial Verification: To start the KYA process, artists are required to provide valid government-issued identification (e.g., passport, driver’s license) to verify their identity. This helps to ensure that each artist’s account corresponds to a real individual or a legally recognized entity.
  • Biographical Information: Artists must submit a brief biography outlining their music career, any affiliations with music labels, and other relevant professional details. This information will be used to create a profile that fans can view, which helps in building a genuine connection with the audience.
  • Proof of Music Ownership: Artists are required to provide proof of ownership or a legal licensing agreement for all music they wish to upload. This is to ensure that all content distributed through Dreamster Music is legally compliant with copyright laws.
  • Affiliation with Recording Labels: If signed to a recording label, artists must disclose this relationship and provide documentation from the label that authorizes them to distribute their music on Dreamster Music. This step is crucial to avoid copyright infringement and to respect contractual obligations with recording entities.
• Ongoing Verification
  • Random Checks: Dreamster Music reserves the right to perform random checks on artist accounts to ensure ongoing compliance with our KYA policy. This may include requesting updated documentation or additional proof of identity or music ownership.
  • Update of Information: Artists are obligated to keep their KYA information current. This includes promptly updating any changes to their music label affiliations, contact information, or legal status.
• Consequences of Non-Compliance
  • Account Suspension: Failure to comply with the KYA requirements, or providing false or misleading information during the KYA process, may result in temporary suspension or permanent termination of the artist’s account.
  • Legal Action: In cases of deliberate fraud or copyright infringement, Dreamster Music may take legal action to protect its users and reputation, as well as to uphold the integrity of the platform.
• Privacy and Data Protection
  • The information collected through the KYA process is handled with strict confidentiality and is protected according to our Privacy Policy. Personal data is used exclusively for verification purposes and is not shared with third parties without consent, except as required by law.

• Use of Fingerprint Technology: Dreamster Music employs advanced fingerprint technology to analyze music data uploaded to the platform. This technology is used to ensure that the music does not infringe on any existing copyrights that may be associated with other recorded works. The fingerprint technology scans each upload to identify unique components of the music, comparing them against a global database that includes copyrighted materials, as well as records of International Standard Recording Codes (ISRC).
• Verification of Licensed Music
  • ASCAP and Other Licensing Bodies: Music that is registered through licensing bodies such as the American Society of Composers, Authors, and Publishers (ASCAP) will undergo additional verification processes. When artists upload music that they claim to have licensed through ASCAP or similar entities, our platform cross-references this information with ASCAP’s databases to confirm the validity of the licenses.
  • Compliance Check: This step is crucial to ensure that all uploaded content adheres to legal standards and respects the rights of original copyright holders. Only after successful verification will the music be cleared for publication on the platform.
• Tokenization and Blockchain Integration
  • Token Assignment: Upon successful upload and verification of the music, a unique token representing ownership and rights over the music is created. This token is then assigned to the content, serving as a digital certificate of authenticity and ownership.
  • Blockchain Storage: The tokens are stored on one of the following blockchains—Binance Smart Chain, Ethereum, or Polygon Matic. These blockchains are chosen for their robust security features, wide adoption, and ability to handle transactions efficiently. The use of blockchain ensures that each token is secure, immutable, and transparently recorded, facilitating trust and ease of verification among users and potential buyers.
• Rights of Artists and Users
  • Artist Rights: Artists retain all intellectual property rights to their music, except for the specific rights granted through the token for distribution and consumption on the platform. Artists have the right to withdraw their music and associated tokens, subject to the terms agreed upon at the time of upload.
  • User Rights: Users who purchase or stream music on Dreamster Music receive a license to access and enjoy the music as per the token’s stipulations. These rights are limited to personal, non-commercial use similar to Vinyl records, cassette tapes, or CDs unless otherwise specified in the token’s terms.
• Responsibility and Liability: Dreamster Music takes proactive steps to ensure compliance with copyright laws but is not liable for any inadvertent copyright infringements committed by users or artists on the platform. Artists are responsible for ensuring that their uploads do not violate any copyrights or other rights of third parties.

• Permitted Uses
  • Personal and Non-Commercial Use: The platform is intended for personal, non-commercial use only. Users are permitted to stream and interact with content within the bounds of the Dreamster Music community.
  • Engagement Features: Users are encouraged to use features such as commenting, sharing, and participating in community discussions to enhance interaction with artists and other fans. These features are provided to build a supportive community around the music and artists featured on the platform.
• Prohibited Actions
  • No Unauthorized Access: You are prohibited from accessing, tampering with, or using non-public areas of the platform, our computer systems, or the technical delivery systems of our providers.
  • No Interference: Interfering with the access of any user, host, or network, including sending a virus, overloading, flooding, spamming, or mail-bombing the platform, is strictly prohibited.
  • No Data Harvesting: Scraping and harvesting of personal data from Dreamster Music without express written permission from the users or the company is forbidden.
  • No Misuse of Content: You may not use any content served on Dreamster Music in any way not expressly permitted by the content licensing agreement. This includes, but is not limited to, copying, modifying, distributing, selling, or leasing any part of our services or included software.
  • No Infringing Activity: Uploading or sharing content that infringes on another's intellectual property, privacy, or other rights is strictly prohibited..
• Content Responsibility
  • User Content: Users are solely responsible for the content they upload, share, or interact with on the platform. Dreamster Music is not liable for any user-generated content that may breach the terms of service.

  • No Endorsement of Content: Dreamster Music does not endorse any content uploaded by its users or third parties and expressly disclaims any and all liability in connection with such content.
  • No Guarantee of Service Levels: Dreamster Music does not warrant that the service will meet your requirements or that the operation of the service will be uninterrupted or error-free. We cannot guarantee that any files or data you download from the site will be free of viruses or contamination or destructive features.
• Limitations of Liability

  • Exclusion of Indirect Damages: Dreamster Music and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the service; (ii) any conduct or content of any third party on the service; (iii) any content obtained from the service; and (iv) unauthorized access, use, or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage.

• Jurisdictional Coverage
  • United States: For users accessing Dreamster Music from within the United States, these Terms of Agreement are governed by and construed in accordance with the laws of the State of Wyoming, without giving effect to any principles of conflicts of law. Dreamster DAO, LLC, registered in Cheyenne, Wyoming, will be the governing entity.
  • United Arab Emirates: For users accessing the service from within the United Arab Emirates (UAE), these Terms are governed by and construed in accordance with the laws of the UAE, and in particular, by the laws pertaining to digital services and copyright as administered in Dubai. Dreamster Web3 DMCC, registered in Dubai, UAE, will be the governing entity.
• Legal Disputes and Jurisdiction
  • Resolution Process: Any disputes or claims arising out of or in connection with these Terms shall first be attempted to be resolved amicably through good-faith negotiations, which shall be a precondition to either party initiating a lawsuit or arbitration.
  • Litigation: If the dispute cannot be resolved through negotiation within thirty (30) days, the parties agree to submit to the exclusive jurisdiction of the state and federal courts located in Cheyenne, Wyoming for the resolution of any disputes arising from or related to these Terms for users governed by U.S. law. For users in the UAE, disputes will be submitted to the exclusive jurisdiction of the courts of Dubai.
  • Alternative Dispute Resolution: Both parties agree that alternative dispute resolution, such as mediation or arbitration, may be sought prior to resorting to litigation if mutually agreed upon at the time of dispute.
• International Considerations
  • Dreamster Music operates on a global scale, and therefore, international laws and regulations may also influence or dictate the terms under which the service operates. Users accessing the platform from other jurisdictions do so on their own initiative and are responsible for compliance with local laws if and to the extent local laws are applicable.
• Enforceability
  • If any provision of these Terms is found by a court of competent jurisdiction to be invalid, the parties nevertheless agree that the court should endeavor to give effect to the parties' intentions as reflected in the provision, and the other provisions of the Terms remain in full force and effect. applicable.

  • Dreamster Music shall not be liable for any failure to perform its obligations hereunder where such failure results from any cause beyond Dreamster Music’s reasonable control, including, without limitation, mechanical, electronic, or communications failure or degradation.
• Third-Party Rights
  • These Terms do not give rise to any third-party beneficiary rights. Only the parties to this agreement may enforce its terms.
• Survival
  • All provisions of these Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
